Associate Vice President and General Counsel

The Associate Vice President and General Counsel will provide comprehensive legal advice and risk analysis for ACHE’s operations and initiatives including compliance in all higher education related matters (Title IV, Title IX, FERPA, HIPPA, etc.).  S/he will serve as a resource for senior management and will report to the President of ACHE.

ESSENTIAL FUNCTIONS AND RESPONSBILITIES

  • Provide legal guidance in the acquisition and development of ACHE properties
  • Provide management oversight in the area of higher education and education compliance including, but not limited to, FERPA, HIPPA as related to medical education, Title IX, and Title IV
  • Draft and review contracts for legal sufficiency and conduct contract negotiations
  • Provide legal analysis and counsel in labor/employment matters
  • Provide day-to-day legal counsel to ACHE stakeholders
  • Build close cross-functional relationships with members of management, and obtain and maintain a solid knowledge of ACHE’s mission and strategy
  • Collaborate with management and internal clients providing regular and timely updates
  • Provide legal advice on a wide variety of matters, including, but not limited to, issues related to premises and other tort liability, student due process, higher education compliance, state and federal legislation, and accreditation compliance
  • Other duties as assigned by the President, CEO, or their designee

QUALIFICATIONS AND CREDENTIALS

Education and Experience

Minimum Qualifications

  • J.D.
  • Graduated from an ABA accredited law school
  • Minimum of five (5) years of legal experience
  • Admitted to practice in good standing in Arkansas; (will consider other state licensed attorneys, but must be able to be admitted to Arkansas Bar within one (1) year of hire

Preferred Qualifications

  • Member of the Arkansas Bar, in good standing
  • Six (6) plus years of legal experience
  • Experience in institutions of higher learning, government, or non-profit organizations
  • Experience in institutions of higher learning that award degrees in health care, including medicine (DO or MD)

Required knowledge, skills, and abilities

  • Excellent judgment and initiative in developing creative and effective solutions, using a business-oriented approach
  • Ability to critically review issues and provide a comprehensive and well-thought analysis orally, as well as in writing
  • Excellent writing and communication skills
  • Ability to effectively counsel internal clients by providing them with clear and concise practical advice based on the facts and sound law, as well as being ethically supported
  • Proficient in setting priorities and managing expectations with respect to deliverables and deadlines
  • Demonstrate proficiency in computer skills, i.e. Microsoft Office, etc.
  • Display professionalism for the college in all communication and interaction
  • Ability to maintain confidentiality and privacy
  • Ability to prioritize and organize numerous and varied assignments
  • High-energy, versatile, and self-directed
